FISHING CAMP LIABILITY WAIVER AND RELEASE AGREEMENT
This Liability Waiver and Release Agreement (the "Agreement") is made and entered into as of the date signed below by and between the undersigned participant (the "Participant") and their parent or legal guardian (if Participant is under 18 years old), and Patrick Mills ("Instructor"), as well as the family and affiliates of the Instructor (collectively, the "Released Parties").
1. Assumption of Risk
I understand that participation in the fishing camp, including but not limited to boarding and disembarking the boat, handling fishing equipment, and exposure to open water, carries inherent risks, including but not limited to drowning, slips and falls, equipment-related injuries, weather-related hazards, and other unforeseen dangers. I voluntarily assume all risks associated with my or my child’s participation in the fishing camp.
2. Release of Liability
I hereby release, waive, and discharge the Released Parties from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any injury, illness, death, property damage, or loss sustained by the Participant while participating in the fishing camp, whether caused by the negligence of the Released Parties or otherwise.
3. Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, suits, damages, costs, or expenses, including reasonable attorney’s fees, brought by any third party in connection with any injury, loss, or damage related to the Participant’s participation in the fishing camp.
4. Medical Treatment Authorization
In the event of a medical emergency, I authorize the Instructor or their designees to obtain emergency medical treatment for the Participant and release the Released Parties from any liability related to such treatment. I understand that I am responsible for all medical expenses incurred.
5. Compliance with Safety Rules
I agree that the Participant will abide by all safety rules and instructions provided by the Instructor. Failure to comply may result in immediate removal from the fishing camp without a refund.
6. Photo and Media Release
I grant permission for photos or videos taken during the fishing camp to be used for promotional or educational purposes, without compensation.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of NC. Any disputes arising from this Agreement shall be resolved exclusively in the courts of [Your County, Your State].
8. Acknowledgment and Signature
I HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I SIGN IT FREELY AND VOLUNTARILY WITH THE INTENT TO BE LEGALLY BOUND.
